The National Court dismisses the complaint filed in Córdoba against Tous because "the buyer is not told to buy solid silver"

The judge of the National Court Santiago Pedraz archives the investigation against Tous by ruling out any possible scam in the marketing of his gold and silver jewelry. Specifically, the Prosecutor's Office accused the jewelry firm of the crimes of misleading advertising, continued fraud, false documents and corruption in business.

In the order, the magistrate rules out that Tous deceived the buyer, since at no time was he told to buy solid silver, so he does not see irregularities in the electroforming technique, according to which the jewel could incorporate non-metallic nuclei depending on their size and shape.

Pedraz rejects "the practice of any other diligence", which the initial complainants, the Consujoya association, requested. After analyzing the publicity and the certificates of authenticity, he concludes that "the pieces in question would be protected by law, as they are considered precious metal".

There is also no record that the consumer "bought the piece thinking that it is solid and the seller let him know so", continues the magistrate, who rejects the possible crimes of misleading advertising and document falsification in relation to the certificate of the company that carries out the contrasts, and that of corruption between individuals as there is no data that supports alleged bribery.

The instructor recalls that the certificates delivered to the buyer state that "articles manufactured using the electroforming process may contain a non-metallic core in order to confer stability." The proceedings began with a complaint filed by the Consujoya association in Córdoba in December 2018. A few months later, in March 2019, the Córdoba Prosecutor's Office initiated investigation proceedings, subsequently inhibiting the National Court Prosecutor's Office, which It was the one that, in November 2019, filed the complaint before the judge.​
