Pro consumer sanctions with RD $ 3 million to Jewelry Rifó Mercedes Benz

SANTO DOMINGO.- The National Institute for the Protection of Consumer Rights (Pro Consumer) sanctioned with 3 million pesos a jewelry of the capital that organized a raffle of a Mercedes Benz vehicle, which was allegedly manipulated to the detriment of thousands of consumers who boughttickets to participate in the same.

Pro consumer, through resolution number 2453-21, also ordered Ronny jewelry, located in the Villa Consuelo sector, the immediate return of the money that consumers paid in the purchase of tickets to participate in said contest, which wasrecently held.

According to a statement from the Consumer Rights Defender Institution, “the Supplier Joyeria Ronny S.R.L, promoted through its social network Instagram the contest “We set up in a Mercedes Benz X only 200 pesos”, in which a Mercedes Benz brand vehicle (model not described), a gold chain valued at RD $ 150,000.00, and a gold chain valued at RD $ 80,000.00 ".

It expresses in that sense, that this institution received multiple complaints in relation to the aforementioned contest, so that the department of advertising and prices analysis, “proceeded to carry out an analysis by which it was verified that advertising presents non -conformities with the law not.358-05 and resolution 009-2011 that regulates raffles, competitions and raffles, as well as resolution 016-2014 that regulates deceptive advertising in the Dominican Republic.

The document says, that the aforementioned analysis was verified to the regulations mentioned, including that the aforementioned contest was published and promoted without being registered with Pro Consumer and that the supplier did not include within the advertisement the corresponding extract of the bases of the bases of the bases of the bases of the bases of thecontest, duly informing the consumer of the conditions, restrictions and important and relevant limitations of the contest.

The institution also says that there is no evidence of the conduct or selection of the winners transparently, so such actions and omissions "constitute infractions by virtue of which established in the legal system in force in the Dominican Republic".

The complainants complain that they were scammed by the organizers of the contest and show a video "in which you can verify the lack of transparency and clarity in the raffle".

Pro consumer also states in a press release sent to the media, which said draw was not carried out in the presence of a public notary nor was it registered in the institution, as established by the regulation.

“As a national authority of the market, we have the obligation to ensure the protection of the economic interests of consumers and users of goods and services, so we proceeded to investigate the complaints received and according to honest commercial uses, with equity and withoutDiscrimination in relations with consumers and users, ”adds the note.

The entity, directed by Dr. Eddy Alcántara, established that any type of situation that is handled outside the norms established in the Dominican Republic "will have Pro Consumer in front of the rights of each of the citizens who have been violated".

"Anyone who acts within businesses without being protected in the different norms of the country, fragmenting or timing the rights of consumers, will have Pro Consumer in front of them defending the national community," he insisted.
